Guidelines prepared for police to protect the rights of sexual minorities

Mr. A, a gay man, was threatened to be exposed as gay to his family and friends by his ex-lover of last year. Mr. A wanted to report it to the police, but he was worried his sexual identity would be revealed during the investigation process so he gave up on reporting the threat.
 

The police made a set of guidelines to protect the rights of sexual minorities during the investigation process.
 
On the 18th, the offices of Seoul’s 31 police jurisdictions announced they created a guideline for police staff concerning sexual minorities. 
 
The guidelines assure that parties connected with an incident will keep confidential matters of sexual identity. This includes:
  • Not recording sexual identity when it is irrelevant to sexual identity.
  • Not allowing information about sexual identity to leak outside 
  • Without fail, obtain prior written consent before informing family members
Derogatory terms such as ‘homo’, ‘pervert’, ‘fag’ and other derogatory slang can no longer be used. If it doesn’t interfere with the investigation, the parties concerned may ask for help from human rights groups as needed.

호모·동성연애자 등 비하 용어 사용불가
 
 
동성애자 A씨는 지난해 헤어진 연인으로부터 다시 만나주지 않으면 가족과 직장에 동성애자인 사실을 폭로하겠다는 협박을 받아 왔다. A씨는 경찰에 신고하고 싶었지만 조사 과정에서 자신의 성 정체성이 드러날 것을 우려해 신고를 포기했다.

경찰이 수사 과정에서 성 소수자의 인권을 보호하기 위한 가이드라인을 만들었다. 

서울경찰청은 관내 31개 경찰서 직원을 대상으로 ‘성 소수자 수사 직무지침’ 가이드라인을 만들었다고 18일 밝혔다. 



가이드라인은 사건 관계자의 성 정체성 비밀 보장을 규정하고 있다. 구체적으로 ▲사건과 무관한 성 정체성 관련 기록 금지 ▲성 정체성 관련 내용 외부 유출 금지 ▲어쩔 수 없이 가족 등에게 알릴 때는 반드시 본인에게 설명하고 사전 동의를 구할 것 등이다. ‘호모’ ‘변태’ ‘동성연애자’ 등 성 소수자를 비하하는 용어도 조사 중 사용하지 못하게 했다. 수사에 지장이 없다면 당사자가 인권단체의 도움을 요청할 수 있도록 배려할 것도 권장했다.
